How Can I found Out When A Seller/Realtor Contract Ends Without ...

Q: I know a particular Realtor who represents a house I?m interested in. And honestly, this is one negative, overbearing woman I don?t want to be involved with. She caused an accident I was in two months ago, and was OH so nasty even though it was her fault. And the answer is not using a buyer?s rep?she?d still find out who I am.

So, I?d like to find out when the contract ends, as I would consider buying the house when she was NOT around. How does one find out when a contract ends without talking to the Realtor, and feeling awkward asking this of the buyer, whom I don?t know at all?

A: Really there is no easy way. The people who know the date will likely not want to tell you. You could wait and see when it expires on the MLS, then approach the sellers directly.

Just get a buyer?s rep. Even if the listing agent knows who you are, they ethically and legally have to give a fiduciary duty to the seller. This duty does not include bad-mouthing or slandering the buyer. In fact, it would likely only make the listing agent look bad. Nowadays, you can buy a home without ever even seeing the listing agent, so if you want the home you should make the offer.

A: Dear TX, find another real estate agent that you want to use and have them look up the property in the MLS. If the status is changed from ?pending? to ?active? then the property is back on the market.

A: A normal listing contract obligates the seller to notify the agent if anyone approaches them on the side and wants to buy the property. Most listing agreements also specify a time period after the listing contract ends during which any buyer who has a documented interest in the home prior to the listing contract ending, approaches the seller the selller is required to still pay the Realtor the commission.

A: You probably don?t want to hear this, but the agent, her broker and the seller are probably the only ones with that information. My recommendation is to speak with the listing agent?s broker or have your buyer?s agent speak with her broker. Most broker?s obviously are going to back up their agents, but they are not going to let personal issues get in the way of their customer?s best interest. Since it is in their seller?s best interest to get their property sold, I would think the listing agent?s broker would be willing to step in for her to close the transaction.

Other than trying that route, you may just have to wait it out and hope the listing expires without selling

A: The best way to find out is to call her directly. You may consider having someone else call on your behalf. You can also call her broker or any other agent within that office should have access to this information.
