?It is well settled that the?violation?of a state statute constitutes?negligence?as a matter of law?.?

This sentence has formed the basis for my current line of research, and legal briefs based on that idea to help two clients, and it comes from?Green v. Gaydon, 174 Ga.App. 796, 798(3),331 S.E.2d 106 (1985).

The basic idea that a particular legal norm, especially in traffic law, can impose possible negligence per se?by its violation, is not something that I have been comfortable with in the past, because my practice is primarily oriented toward domestic relationships, such as child custody and adoption, and (for roughly ten years) criminal practice, where the State itself is the victim and violation of the legal guidelines and rules results in incarceration, fines, and logical punishment. ?Money damages are not a standard that I am used to dealing with, though many or most of the legal norms I originally studied in law school were geared toward those complex civil rules and practices. ?The case, which actually makes for a more complex standard than simply whether a legal rule was violated for purposes of imposing liability, is as follows, and contains an excellent discussion of the distinction at stake with the standard of liability it stands for in Georgia:

????????The 14-year-old son of appellant Linda Jane Green died as a result of injuries he sustained when his motorcycle collided with a tractor-trailer operated by appellee Donald Gaydon, who was in the employ of appellee National Freight, Inc., at the time. This appeal is from a judgment entered on a jury verdict in favor of the appellees in a wrongful death action against them.

????????The collision occurred as Gaydon was driving away from his residence, which was located on a dirt road, and was approaching an intersection with a paved road at a slow speed. There was evidence that appellant?s son had pulled onto the paved road in front of another vehicle and was looking behind him when he turned onto the dirt road and collided with the tractor. Held:

????????1. Appellant contends that the trial court erred in refusing to admit evidence that Gaydon had been told by a representative of either the sheriff?s department or the post office not to park the tractor on the road outside his residence unless he unhitched the trailer and left it at a barn on the paved road, ostensibly because the dirt road was too narrow to allow other vehicles to pass. There was evidence that the road was wider where the collision occurred than at appellant?s residence, which was a substantial distance from the site of the collision.

????????Generally, it is not permissible to show conditions at places other than the one in question for the purpose of establishing that the condition at the place in question is dangerous.?See?MARTA v. Tuck, 163 Ga.App. 132(5),?292 S.E.2d 878 (1982);?Underwood v. Atlanta & West P.R. Co., 105 Ga.App. 340(5),?124 S.E.2d 758 (1962). Because the condition of the road at the point of the collision was different from its condition at appellant?s residence, the evidence which appellant sought to elicit was irrelevant to the issue of whether Gaydon?s conduct at the time and place of?the collision constituted?negligence. Accordingly, the trial court did not err in refusing to admit the evidence.

????????2. Appellant contends that the trial court erred in refusing to give two requests to charge; however, these requests to charge are not contained in the record. The party asserting error has the duty to show it by the record, not by assertions in briefs.?See?York v. Miller, 168 Ga.App. 849,?310 S.E.2d 577 (1983);?DeJong v. Stern, 162 Ga.App. 529(2),?292 S.E.2d 115 (1982). Appellant has made no contention that the record is incomplete, nor has she attempted to supplement the record, pursuant to OCGA ? 5-6-41(f). Consequently, this enumeration of error presents nothing for review. Moreover, even if the language of the two requests to charge was in fact as?set forth in the appellant?s brief, the trial court would not have erred in refusing to grant them. The first specified that a motorist approaching children on the street must consider their tenderness of age and exercise greater caution than that necessary on the discovery of adults in the [174 Ga.App. 798] same situation.?See generally?Kennedy v. Banks, 117 Ga.App. 197, 199,?160 S.E.2d 208 (1968). However, the deceased in the present case was 14 years old and was thus responsible for both his crimes and his torts.?See OCGA ?? 16-3-1, 51-11-6;?Hatch v. O?Neill, 231 Ga. 446(1),?202 S.E.2d 44 (1973);Brady v. Lewless, 124 Ga.App. 858,?186 S.E.2d 310 (1971). It follows that the principle of law at issue was not adjusted to the evidence. Accord?Townsend v. Moore, 165 Ga.App. 606(2),?302 S.E.2d 398 (1983);?Central R. Co. v. Phillips, 91 Ga. 526(2),?17 S.E. 952 (1893). The other request pertained to the last clear chance doctrine, a principle upon which the trial court did instruct the jury, although not in the precise language allegedly requested. The trial court also accurately charged the jury with request to contributory and comparative?negligence?and other relevant principles. Where the trial court accurately and fully charges the relevant law, it is not error to fail to charge in the exact language requested. Accord?Ponder v. Ponder, 251 Ga. 323(3),?304 S.E.2d 61 (1983). Jury instructions must be read and considered as a whole in determining whether the charge contained error.?Taylor v. State, 252 Ga. 125(2),?312 S.E.2d 311 (1984). Considering the charge of the trial court in its entirety, we hold that the jury was accurately informed of the relevant legal principles.

????????3. Appellant contends that the trial court erred in charging the jury that operation of a motorcycle not equipped with a horn and headlight or operation of a motorcycle without wearing protective headgear constitutes a?violation?of the law, and that if the jury found the deceased had violated one of these laws and that such?violation?was the proximate cause of his death, they should return a verdict for the appellees. It is well?settled that the?violation?of a state statute constitutes negligence?as a matter of law, imposing liability on the violator to the extent that any such?violation?contributed proximately to the claimed injuries.?Accord Intl. Brotherhood of Electrical Workers v. Briscoe, 143 Ga.App. 417(7b),?239 S.E.2d 38 (1977);?Peek v. Miller, 119 Ga.App. 138(4),?166 S.E.2d 377 (1969). It follows that this enumeration of error is without merit.

????????4. Appellant contends that the trial court erred in its charge to the jury by using the term, ?head-on,? with reference to the collision. However, no such objection was raised at the trial, and appellant accordingly wavied the?right?to raise the issue on appeal. Accord?Segars v. Printing?Service Co., 170 Ga.App. 345(1),?317 S.E.2d 322 (1984).?See also OCGA ? 5-5-24(a).

????????Judgment affirmed.

I don't read the New York Times' newish columnist Frank Bruni much. And I don't know why this caught my attention this morning. In one respect, it belabors an obvious point. But that is the point, that something so obvious gets relatively little attention.

He uses Whitney Houston's death (and Amy Winehouse's) as a takeoff on the ill effects of alcohol abuse. He notes how little public alarm and government reaction accumulate against it in comparison with tobacco corn syrup and other agents harmful to health.

Although some states have increased the sales taxes on alcohol over the last few years, they?ve typically done so in search of badly needed revenue and in the hope that it won?t dampen consumption ? not as a public health measure aimed at reducing drinking.

?It?s amazing,? Wagenaar said. ?There are scientists and epidemiologists counting all the bodies from alcohol-related problems, but only a few of them are looking at tax rates.?

And while some states restrict the marketing and promotion of alcohol, the overall advertising climate remains permissive enough that between 2001 and 2009, the average number of commercials for alcohol seen yearly by a teenager who regularly watched television rose to 366 from 217, according to a study for the Center on Alcohol Marketing and Youth at Johns Hopkins.

I?m not interested in reanimating Carry Nation, and I?m not about to abandon my white Burgundy or gin martinis. But I?m confused by the paucity of public discussion about all this. I?ve heard more calls for taxes on sugary soft drinks than for an overdue examination of taxes on booze.

Speaking of Whitney Houston: Maybe I overlooked it, but I don't think I saw a reference to her funeral in the Sunday Democrat-Gazette. It was background music in my house for four hours Saturday afternoon, a remarkable cultural event if not "news" in a classic sense. Despite all the talk about the trillions of dollars being made in the technology business, Real Estate is the single greatest engine for creating millionaires and billionaires ever discovered. One of the great things about being in Real Estate is that you don?t have to be in?business, you simply collect a rent from people in business.

Let?s close our eyes and imagine we decide to build a shopping mall. Great! All these stores move into our mall, and we provide them with empty space. They improve the space, the stock it with wares, they employ people to provide services and sell goods, and they pay us a fixed rent, expenses for electricity and other services, and perhaps we even charge them a certain cut of their sales on top of all that. Sweet.

We need a location. Land costs money, so we look around at various jurisdictions, towns where we could buy up some vacant land and build our mall. We?re building a ?Destination Mall,? a place that attracts its own traffic, so we don?t have to buy pricey property downtown in a metropolis. We?ll build our own off-ramp from the superhighway, we?ll erect our own billboards sending drivers to our mall, we just need a nice town, clean and safe, where the local authorities are eager to attract businesspeople.

We find a nice place. The inhabitants are a touch puritanical, their schools seem to have a real issue with teaching evolution or sex education, but that is not our problem, we are building a business, and they seem to love business, it?s in their blood. Fine. We do a deal, and put up a mall. Naturally this brings revenue into the town, we hire people to build and run our mall, we?re attracting jobs. We like to think of ourselves as good corporate citizens.

The tenants move in, the mall thrives, pretty soon there are 400,000 customers a month going through our welcoming doors and business is doing very nicely, thank you.?One day, there?s an urgent phone call from one of our tenants. He?s shouting incoherently about a problem at the mall. As you?re trying to get him to calm down and explain, you see there are calls waiting from other tenants. Your email inbox starts to gyrate like a drunkard with Delirium Tremens. Your assistant sticks her head in the door of your office. The press are outside, they want to interview you about the problem at the mall.

WTF!?

You head straight over. There are news vans filling the parking lot and angry mobs of customers milling about. All the lights are off and the doors seem to be padlocked closed. You push through the throngs to the doors. There are swaths of police tape over the doors, ?crime scene investigation.? It seems the police have shut down the entire mall. You look around for the police, but they are nowhere to be found.

You rush to the nearest police station to find out what is going on. You were not called, you did not receive any paperwork, the mall was just closed. On your way, you notice that your billboards have been papered over with massive signs, ?Mall closed because of criminal activity.? Your business is being ruined, and you don?t even know why. The policeman at the station is very nice, but he explains that it has nothing to do with him, they got a request from the Fraud Squad, and they complied. Was there, you wonder, any court order? The policeman shrugged. ?I get a call from Fraud,? he says, ?I do what they ask.?

You call the number he provides. It takes you a few hours of leaving messages, calling back, getting redirected, and finally you reach a woman who says she?s in charge of this case. ?I have to review the files,? she says, ?I?ll get back to you in a few days when we?ve decided what to do.? A few days! What on earth could have provoked this kind of draconian action of closing an entire mall?

?Well,? she says, ?I can?t disclose any particulars, but we received a tip that one of the businesses in your mall is stealing from customers. Skimming bank card details perhaps. Maybe getting them to divulge personal information in the guise of applying for a loan. Like I said, I have to review the file. Either way, your mall is a de facto centre of criminal activity, so we closed it. Once we?ve had a look, we?ll figure out if we can reopen the mall.?

The Program

Aren't they asking you to help them spy on your tenants and their customers?

?It's not spying, no, spying on our citizens is prohibited by law. We're investigating crimes. We''re the good guys, remember? You're just being a good coporate citizen, not one of those companies acting as a safe harbour for our enemies, right? All the Big Boys are onside with this. Racial disparities persisted in the report, as deaths from diabetes were 2.5 times higher among blacks than whites in Hamilton County, and heart disease-related deaths were 61 percent higher among blacks.

In 2008, 45.4 percent of Hamilton County births were to single mothers, compared with 39 percent in 2001.

Fouls lead to an Alex Caceres loss while Matt Brown is back on track at UFC 143

LAS VEGAS -- Twice, Alex Caceres landed kicks to Edwin Figueroa's groin that looked like he was attempting to nail 60-yard field goals. But they cost him an extra point and the decision in their bantamweight bout on Saturday at UFC 143.

Caceres landed his first kick early in the first round at Mandalay Bay, which sent Figueroa rolling across the mat in agony. Referee Herb Dean issued Caceres a "strong warning" after Figueroa signaled he was able to continue.

The rest of the first round was wild, as Figueroa connected with a head kick and nearly finished the fight, but Caceres rallied and went for several submission attempts late in the round.

Midway through the second, Caceres struck again. This time, Dean took the highly unusual step of docking the fighter two points for the infraction as the fight continued.

Figueroa won round three on all three cards. The scores were 28-27 across the board, two for Figueroa and one for Caceres. If there had been a standard one-point deduction, the bout would have been a majority draw, with two 28-28 cards and a 29-27 for Caceres.

"I felt like it was a hard earned paycheck," said Figueroa. "He was a good fighter. I had to dig deep for this one.? He came out and landed a few shots early.? It was a tough fight but I came out the winner."

The loss was the third in four fights for Caceres, the former "TUF" standout. Figueroa was won two straight.

"Immortal" Brown back on track.

Matt Brown may or may not be "Immortal," as his nickname suggests, but he sure has managed to hang around in the UFC's welterweight division.

Brown has grinded his way through 11 UFC fights since 2008, showing promise, but never quite building enough momentum to break through. But he's hoping to turn the page in 2012 after scoring a knockout victory over Chris Cope at UFC 143 Saturday.

"That's exactly what I need to be doing," said Brown (13-11) "I got away from who I am."

Brown controlled the action in round one against a tentative Cope (5-4), but never got an opening to do serious damage. That changed early in round two, when he feigned a left, followed with a big right hand that connected, then floored Cope with a left hook. He landed a few more shots on the ground before referee Kim Winslow stopped it at 1:19.

The win came as a relief to Brown, who had lost four of his previous five fights. "I've got a right hand to knock out anybody, I hope to see more of that."
